If Dual Agency DOES NOT apply in a transaction, do the buyers and seller still need to sign the bottom of the dual agency box of the Purchase Agreement?
No. The language is required by statute to be in a Purchase Agreement if circumstances create a dual agency situation. Therefore, the parties should sign this section only if dual agency applies in the transaction.
