Mediation

Buyer-Seller Mediation Services

The Minnesota Association of REALTORS® has created a program that provides mediation services to interested parties as an alternative to arbitration and litigation. In today's litigious society, increasing numbers of people are finding that mediation is a more satisfying process than arbitration or litigation in the resolution of disputes.

What is Mediation?

Mediation is a process in which the parties, with the assistance of a qualified neutral Mediation Officer, attempt to resolve their dispute based on the factual information, without focusing on who is right and who is wrong or what is equitable (two legal concepts). Instead, the parties focus on what each is willing to do to put the dispute behind them.

During the mediation conference, the parties tend to concentrate on their highest priorities and move towards a compromise on lower priority issues. The Mediation Officer will attempt to create and maintain an atmosphere of communication between the parties while facilitating their negotiation.

Initiating a Claim

Mediation is a viable alternative to litigation or formal arbitration. Consider resolving your disputes by electing to use our mediation services. To initiate the process, please download MNAR's "Mediation Rules and Guidelines" and "Request to Mediate Form."
